Terms of service

What you can expect from Benaiah, what you control, and how paid features work.

Version 13 September 2026 · You can print or save this page for your records.

A paid phone plan includes your team's intelligence, speech and supported tools. Agent Wallet money is separate and is never charged for AI usage or calls. Your consumer rights are not reduced by these terms.

1. Who provides the service

Benaiah.ai is provided by Benaiah AI Ltd, company number 17403584, registered in England and Wales. Our registered office is 167–169 Great Portland Street, 5th Floor, London W1W 5PF, United Kingdom. Contact us at [email protected].

These terms cover the Benaiah website, account, AI teammates, supported desktop and mobile experiences, and Benaiah integrations. A separately agreed business contract or the specific terms shown for a purchase may add to them. We will identify any different terms before you agree. Our privacy notice explains personal-data handling; agreeing to these terms does not opt you into optional improvement use.

You must be at least 13, or the higher minimum age applicable to you. If you are under 18, a parent or guardian must authorise your use and any purchase. Individual payment, wallet and connected-service providers may impose higher age or eligibility requirements. If you act for an organisation, you must be authorised to do so.

2. Your account and available features

Keep your account details accurate and protect your sign-in methods, devices and API credentials. Tell us promptly if you suspect unauthorised access. You are responsible for permissions you grant to teammates and connected services, but this does not make you responsible for losses caused by our failure to meet our obligations.

An active paid phone plan is required to use Benaiah teammates, intelligence, speech and supported tools. There is no free plan or trial. Account access, plan purchase, balance funding, receipts and recovery remain available before purchasing a plan. Each plan includes the usage shown at checkout. Usage pauses at the included allowance. Benaiah does not debit Agent Wallet money or purchased service funds for additional AI work or calls. Existing payments and receipts are retained.

Only features enabled for your account are available to use. A preview, partner approval, waitlist or integration setting does not mean a feature is generally available. Compatibility may depend on your browser, device, network and connected provider. Computer-based subscription connections require the relevant computer and software to remain available; a third-party subscription is not a promise of free Benaiah voice, calls or other paid services.

3. Phone plans, existing credits and wallet funds

Your phone plan includes Benaiah service usage. Wallet funds are assets held at a wallet address; a budget limits authorised spending outside Benaiah. Existing service Credits and receipts are preserved, and settled service funds may be used to explicitly purchase a month of a phone plan. Service Credits are not Agent Wallet deposits and do not fund external purchases.

Before a purchase or paid action, review the amount, currency, applicable taxes and fees, and any maximum usage charge shown. Purchased Credits do not expire. No new trial Credits are granted. Historical grants and receipts remain recorded but do not unlock work without a paid phone plan. Credits are not an investment, a bank deposit or a generally transferable payment instrument. Statutory refunds and corrections remain available.

Plan work reserves included usage before starting. Historical service-credit work and existing resource contracts may retain their original monetary reservations. We settle verified usage and release any unused reservation once the outcome is established. If a provider has not supplied reliable usage information, the reservation may remain pending; a pending hold is not a final charge. Contact support if a hold appears incorrect or does not resolve. We will investigate disputed usage and correct billing errors.

Optional automatic top-up is off until you enable it. Its amount, threshold and automatic-purchase cap are shown when you authorise it. You can turn it off in Credits. Turning it off prevents new automatic purchases; an already processed purchase or authorised usage may still need settlement. Your manual purchases are separate from the automatic-purchase cap.

4. Wallets and external payment providers

Where available, wallet funding and conversion are supplied through the providers identified during checkout. Payment methods, exchange rates, fees, networks, eligibility and identity checks depend on the route. Apple Pay or Google Pay is not available for every transaction. A bank or provider may require a separate window, app or verification step.

USDC and other digital assets are not the same as a bank balance: values, liquidity and network availability can change. Check the asset, network, address, amount and fees before authorising a transfer. Blockchain transactions may be irreversible. Do not assume a visible wallet can withdraw or spend until that capability is explicitly enabled.

An enabled wallet-to-Credits purchase requires separate approval and verified receipt of the correct asset on the correct network. A browser success message alone does not establish settlement. Partial, late, excess or wrong-network payments may need manual investigation; recovery is not always technically possible. We will explain any available recovery and its costs before you approve it. These limitations do not remove rights you have against us or your payment provider.

5. Cancellation, refunds and ending use

You can stop using Benaiah at any time, disable automatic top-up and ask us to close your account. Cancel queued tasks and recurring instructions separately: signing out or disconnecting an integration does not cancel work already authorised. Usage already incurred still needs reconciliation.

If you are a UK consumer purchasing online, you normally have a 14-day cancellation period from entering a service contract. Contact us within that period to cancel. If you expressly request a service to start during that period, we may charge a proportionate amount for the service actually supplied where the law permits. Any loss of cancellation rights for fully supplied services or immediately supplied digital content requires the legally necessary prior consent and acknowledgement; acceptance of these terms alone is not that consent.

To cancel, email [email protected] with your account email, order or receipt reference and a clear statement that you wish to cancel. You may use this optional wording: “I give notice that I cancel my contract for [service/order], ordered on [date]. My name is [name], my address is [address], and today’s date is [date].” A signature is needed only if you send a paper notice.

Where a refund is due, we will make it within the applicable legal deadline, normally within 14 days of being informed of cancellation, using the original payment method unless otherwise agreed, without a refund fee. Outside statutory cancellation rights, contact us about unused Credits, mistaken purchases or failed services so we can assess the circumstances. We do not impose a blanket “no refunds” rule. If we permanently discontinue a paid service and cannot supply the purchased capacity, we will offer an appropriate remedy for unused purchased Credits.

6. Teammates, actions and telephone calls

AI teammates are software, not people. They can make mistakes, omit information or produce inaccurate output. Review important results before relying on them. Benaiah does not replace professional advice, emergency services or your own judgement. We do not promise that a task will achieve a particular outcome.

Grant only the access and spending permissions needed for your task. A prepared action is not proof it has happened. Some actions require a separate approval, and external systems may fail or respond late. Do not repeat an uncertain payment or call simply because a response is delayed; check its status first.

The initial ChatGPT plugin supports supplied-context analysis and drafting, task status, and eligible personal callbacks. It does not grant access to your entire ChatGPT history, browse the web or perform connected-app actions. Public directory availability depends on review and publication. Calls require a verified personal callback number, available capacity and the applicable spending approval.

Telephone eligibility and provider terms

Telephone callbacks require you to be at least 18, meet any higher applicable age of majority, and affirmatively enable calls when connecting your account. You can use general teammate and task features without enabling calls. Calls through this plugin go only to your own verified UK personal number and require your approval of the maximum charge. Reconnecting with calls disabled prevents new calls; it does not end a call already placed.

You are speaking with an AI teammate. Speech is transcribed; conversation content and shared task context are processed by ElevenLabs and the relevant model providers to deliver the call. Audio recording is disabled for the current plugin callback route. Transcript and operational-record retention are explained in our privacy notice.

For telephone features supplied using ElevenAgents, you agree to the applicable end-user restrictions in the ElevenAgents Service-Specific Terms, ElevenLabs UK/EEA Terms of Service and Prohibited Use Policy. The ElevenAgents terms take precedence for that service where their provisions differ. Use the agents only for your personal use or internal business use; do not resell the underlying service, defeat its safeguards, infringe others’ rights or use it for unlawful or prohibited purposes. Do not submit payment credentials, government identifiers, health information or other data requiring elevated protection through these calls. Sexual or other prohibited content is not supported.

Benaiah is an independent service provider, not an agent, partner or joint venture of ElevenLabs. ElevenLabs is an intended third-party beneficiary of the provisions of these terms relating to its service. You grant ElevenLabs, its affiliates and subcontractors a non-exclusive right to access and process the data you supply through that service as needed to provide, operate and support it, subject to applicable privacy and data-protection terms. This permission does not itself authorise optional use of your content for Benaiah model improvement or remove your statutory rights.

A call may connect to voicemail, fail or be interrupted, and carrier or provider usage may still be incurred. A call already placed cannot be recalled by cancelling its task. Never use Benaiah for emergency calling, deceptive impersonation, harassment or unauthorised marketing. Where you involve other people, obtain any consent required for AI interaction, recording, transcription or contact. We must also meet the disclosure and consent obligations that apply to our role. Voice cloning is limited to the consented use supported in the product; it does not authorise impersonating someone else.

7. Your content and acceptable use

You keep your rights in the content you provide. Give us only content you are entitled to use and share. You grant us permission to process it as needed to deliver, secure and support the features you request, as explained in the privacy notice. Optional use for improvement is controlled separately.

As between you and Benaiah, you may use the outputs supplied to you, subject to applicable law and third-party rights. AI output may not be unique or eligible for intellectual-property protection. We do not guarantee exclusive rights or that every output is free of third-party claims. Our software, branding and other service materials remain ours or our licensors’.

Do not use the service for unlawful activity, fraud, abusive contact, unauthorised access, malicious code, evading security or spending controls, or infringement of another person’s rights. Connected providers’ applicable terms also apply to their services. We will not describe a provider connection as permission to act beyond the access you granted.

8. Changes, suspension and responsibility

We may make proportionate changes for security, reliability, legal requirements or product development. We will give reasonable notice of material changes affecting paid use where practicable, explain the effect and provide a fair route to stop using the affected service. A new price does not retrospectively change an accepted purchase or completed usage charge.

We may restrict access where reasonably necessary to protect people or systems, respond to suspected misuse or comply with law. We will explain the reason and how to challenge it where lawful and safe. Suspension does not automatically forfeit unused purchased Credits or remove rights to a refund.

We will provide paid services with reasonable care and skill. We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. Nothing here excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything that cannot lawfully be excluded. Your statutory rights concerning services and digital content remain in force.

9. Complaints and applicable law

Contact support about access, billing, privacy or service complaints. Include enough information to identify the issue, but never send passwords, verification codes, private keys or complete card details. We will investigate and explain the available next steps.

These terms are governed by the law of England and Wales. If you are a consumer elsewhere, this does not deprive you of mandatory protections or rights to bring proceedings in your home jurisdiction that apply to you.
